1. Agreement to Terms

By accessing or using Scouq ("the Platform"), operated by Scouq Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Scouq is a real estate investment analysis platform that provides property data aggregation, deal scoring, strategy comparison, portfolio tracking, and market intelligence tools. The Platform is designed for informational and analytical purposes only.

3. User Accounts

To access certain features, you must create an account using Google OAuth or email authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as needed. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription Plans and Billing

Scouq offers the following subscription tiers:

All paid subscriptions are billed in advance on a monthly or annual basis. Prices are subject to change with 30 days written notice to existing subscribers.

Subscription plans (Personal, Professional) include a 7-day free trial. A payment method is required at checkout; you will not be charged until the trial ends. You may cancel anytime during the trial through your account billing portal. The Lifetime plan is a single payment and does not include a trial.

You may cancel your subscription at any time through your account billing portal. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing cycle.

Lifetime plans include all features available at the time of purchase and all future updates to existing features. Entirely new product lines launched separately are not guaranteed under a Lifetime plan.

Refunds. Lifetime purchases may be refunded within 14 days of purchase by emailing hello@scouq.com. After 14 days, Lifetime purchases are non-refundable. Monthly and annual subscriptions are non-refundable for unused portions of the current billing cycle; cancel anytime via your account billing portal to prevent renewal. Disputed charges should be addressed with us first before initiating a chargeback.

Scouq provides analytical tools and data aggregation for informational purposes only. Nothing on this Platform constitutes financial advice, investment advice, legal advice, or tax advice. All deal scores, strategy comparisons, market data, and AI-generated analyses are estimates based on available data and should not be relied upon as the sole basis for any investment decision.

Scouq is not a licensed real estate broker, appraiser, lender, or housing provider. Property valuations, rent estimates, ARV figures, and deal scores are automated estimates (AVMs), not appraisals, and are provided for informational use only. Scouq complies with the Fair Housing Act and does not provide or analyze demographic information about current or prospective residents. We do not collect, infer, or expose data about race, color, religion, national origin, sex, familial status, disability, sexual orientation, gender identity, or source of income.

Real estate investment involves significant risk, including the potential loss of principal. Property values, rental income projections, and market conditions can change without notice. You should consult with qualified financial, legal, and real estate professionals before making any investment decisions.

We do not guarantee the accuracy, completeness, or timeliness of any data or analysis provided through the Platform. Past performance indicators shown on the Platform do not guarantee future results.

7. Intellectual Property

The Platform, including its design, code, features, branding, and content, is owned by Scouq Inc. and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Platform for your personal or internal business purposes.

You retain ownership of any data you input into the Platform. By using the Platform, you grant us a limited license to process, store, and display your data solely to provide the services you have requested.

8. Third-Party Services and Data

The Platform integrates with third-party services including mapping providers, data aggregators, and AI models. We are not responsible for the availability, accuracy, or reliability of third-party data or services. Third-party services are subject to their own terms and privacy policies.

9. Limitation of Liability

To the maximum extent permitted by law, Scouq Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, investment returns, or business opportunities, arising from your use of the Platform.

Our total liability for any claim arising from these terms or your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Scouq Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these terms, or your violation of any third-party rights.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will make reasonable efforts to notify subscribers of material changes. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

12. Termination

We may terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we determine violates these terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Platform ceases immediately. You may request an export of your data within 30 days of termination by contacting us at the email below.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the state or federal courts located in Delaware.

14. Severability

If any provision of these terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Scouq Inc. regarding your use of the Platform and supersede all prior agreements and understandings.
